AGREEMENT


BAYMR – the online store hereinafter referred to as “Baymr” and www.baymr.com website hereinafter referred to as the “Site”, on the one hand, the participant hereinafter referred to as the “Participant”, and collectively hereinafter referred to as the “Parties”, have entered into this agreement as follows:

GENERAL RULES:

  • The “Site” is open for use by everyone.
  • Becomes (To Be) a member of the “Site” for free.
  • The “Member” can use all the services, provided that the phone number and password are entered.
  • When a “Member” begins to use the site or application, it is accepted as acceptance of all the terms of this agreement.
  • This agreement will cease to apply when you cancel your participation in the site.
  • Baymr has the right to unilaterally change and supplement the obligations of the agreements.

Rights and obligations of the “Participant”

Obligations of the “Participant”:

  • Acceptance of goods by order from “Baymr” at the agreed time and in accordance with the quantity and quality of the goods, is carried out in the presence of the necessary documents for the goods.
  • After receiving the goods, the “Participant” is obliged to fully settle with “Baymr” on the basis of invoices.
  • In case of refusal of the order, the “Participant” undertakes to notify “Baymr” in writing 2 (two) days before the delivery of the order.
  • The “Participant” while using the site is obliged to act in accordance with the norms of the current legislation of Turkmenistan

Rights of the “Participant”:

  • Find out the information stored in our data about the “Member”.
  • If your data has errors or is incomplete, you can change or cancel it.
  • If you have forgotten your password, you can use the “Forgot Password” feature
  • In case of expiration of the order, you have the right to cancel the order.
  • In case of non-compliance of the type and quality of the goods, you can refuse the order

          Права и обязанности “Baymr”

          Baymr’s responsibilities:

          • The “Participant” shall be provided with goods in the quantity and quality shown and at the specified time.
          • “Baymr” undertakes to deliver the goods by its own vehicles, or at its own expense
          • Obligation to supply quality goods according to the relevant standards.
          • Baymr undertakes to respect the confidentiality of the Member’s information. And in turn, the “Participant” undertakes to maintain the confidentiality of information, password and accounts, not to give access to third foxes.
          • “Baymr” undertakes to provide invoices and cheques on the basis of the order
          • In case of cancellation or replacement of the order, after notifying the “Participant”, “Baymr” undertakes to deliver the replacement order 10 (ten) days in advance.
          • On changes in prices for goods, notify the “Participant” in advance.

                      The rights of the “baimr”:

                      • After receiving the goods on the basis of invoices, demand full settlement with Baymr.
                      • Offer new products to the “Participant”.
                      • If the “Member” during the use of the site did not act in accordance with the norms of the current legislation of Turkmenistan and violated the agreement, “Baymr” has the right to cancel the agreement.

                          Liability of the parties

                          • “Baymr” is responsible for fulfilling the orders of the “Participant” at the specified time
                          • After receiving the goods, the “Participant” is responsible for the full settlement with “Baymr” by agreement.
                          • It is the responsibility of the “Participant” to keep the Operator records between the “Participant” and “Baymr”.
                          • If the “Participant” has lost the data, “Baymr” shall not be liable for this.

                                Special conditions

                                  • The “Member” must not interfere in any way with the operation of “Baymr” or the “Site”. If there is damage or damage to the “Site” or any other disturbance to other users, “Baymr” will exclude the “Participant” from use and in cases not provided for by this agreement, the liability of the parties is determined in accordance with the current legislation of Turkmenistan.
                                  • The “Member” must keep his password and guarantee that he will use the site for its intended purpose. On the part of the “Participant” when using the site, if he entered an incorrect password or did not use the site for its intended purpose and at the same time there were expenses between the “Parties”, then the financial responsibility of the “Participant”.

                                  Intellectual Property Rights

                                  • The information, images and content contained in the website may not be copied, distributed, reproduced, loaned, modified or stored for future use, in whole or in part, without the prior written permission of Markaly. All content of the website (texts, data, graphics, images, logos, button symbols, databases, designs, software and other elements related to the content of the website) are the intellectual and industrial property of Markaly and our official partners. All rights to the texts, graphics, images and all photographs available on the website are reserved.
                                  • The use without authorization of all financial rights relating to the content of the website, its design and software (processing, reproduction, publication, presentation and public display), as well as, without limitation, all cases of disclosure and use without authorization constitute infringement of intellectual and industrial property rights.

                                  Force majeure

                                  • In the event of force majeure, such as, for example, natural disasters, political problems and others, the “Parties” shall not be liable for full or partial performance of obligations after the agreement.
                                  • If the force majeure circumstances last more than 3 months, the parties may agree to terminate the agreement.

                                  Dispute Resolution Procedure

                                  • The Parties agreed to resolve all disputes and disagreements through negotiations, if it is not possible to resolve disputes through negotiations, the dispute that has arisen is subject to resolution in the Arbitration Court of Turkmenistan.
                                  • The decision of such court shall be final and binding on both Parties.
